DMCA Policy

1. Respect for Intellectual Property

MCFRLive respects the intellectual property rights of others and expects users of the Service to do the same. We comply with the Digital Millennium Copyright Act of 1998 (the "DMCA") and will respond to notices of alleged copyright infringement that comply with the DMCA and any other applicable intellectual property laws.

If you believe that material available on or through mcfrlive.com infringes your copyright, you may request removal of that material by submitting a written notification to our designated DMCA agent as described below.

2. Filing a DMCA Takedown Notice

If you are a copyright owner, or are authorized to act on behalf of one, and you believe that copyrighted material has been copied or made available through the Service in a way that constitutes copyright infringement, please submit a notification pursuant to the DMCA by providing our designated agent with the following information in writing (see 17 U.S.C. Section 512(c)(3) for further detail):

  1. Physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works on the Service are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Please provide the specific URL(s) where the allegedly infringing material is located.
  4. Your contact information, including your name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Important: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorney's fees incurred by us or by the alleged infringer who is injured by such misrepresentation.

3. Counter-Notification Process

If you believe that your material was removed or disabled by mistake or misidentification, you may file a counter-notification with us by providing the following information in writing:

  1. Physical or electronic signature of the subscriber (you).
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you are outside the United States, for any judicial district in which we may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, we will promptly forward a copy to the original complaining party. If the original complaining party does not file a court action seeking a restraining order against you within ten (10) to fourteen (14) business days after receiving the counter-notification, we will restore the removed material or cease disabling access to it, in accordance with the DMCA.

4. Repeat Infringers

In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

5. Note Regarding Public Dispatch Data

The dispatch data displayed on MCFRLive is derived from publicly available government records (the Martin County Fire Rescue public CAD feed). Government works in the United States are generally in the public domain and are not subject to copyright protection under 17 U.S.C. Section 105. DMCA takedown notices directed at the display of public dispatch data will be evaluated on a case-by-case basis with this legal framework in mind.
