Terms of Service

1. Acceptance of Terms

By accessing or using the MCFRLive website at mcfrlive.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and MCFRLive ("we," "us," or "our").

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date and, for registered users, by email notification. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

2. Description of Service

MCFRLive is a free, public platform that displays fire and rescue dispatch data for Martin County, Florida. The Service aggregates data from the Martin County Fire Rescue public Computer-Aided Dispatch (CAD) feed and presents it in a searchable, accessible format. Features include a live incident feed, incident archives, unit tracking, map views, statistical reports, weather integration, push notification alerts, and optional Pro subscription features.

MCFRLive is an independent project. It is not affiliated with, endorsed by, or connected to Martin County government, Martin County Fire Rescue, Martin County Board of County Commissioners, or any government agency.

4. Data Accuracy Disclaimer

All dispatch data displayed on the Service is sourced from the Martin County Fire Rescue public CAD feed. We display this data substantially as received and do not independently verify its accuracy or completeness. You acknowledge and agree that:

• Data may be delayed by the polling interval (approximately 30 seconds) or by delays in the source feed itself.
• Data may be incomplete, as the public CAD feed does not include all information available to dispatchers or responders.
• Incident types, locations, unit assignments, and other details may change after initial dispatch and may not be immediately reflected on the Service.
• Address information displayed is approximate and may not reflect the precise location of an incident.
• The CAD feed may experience outages or interruptions beyond our control, during which no data will be available.
• We make no representation that the data is suitable for any particular purpose, including but not limited to insurance claims, legal proceedings, property assessments, or personal safety decisions.

5. User Accounts

Certain features of the Service require you to create an account. When you create an account, you agree to:

• Provide accurate and complete registration information.
• Maintain the security of your account by protecting your email and not sharing access to your account with others.
• Promptly notify us of any unauthorized use of your account.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate your account at any time, for any reason, including but not limited to violations of these Terms, abusive behavior, or activity that disrupts the Service.

6. Pro Subscriptions and Billing

MCFRLive offers an optional Pro subscription that provides access to enhanced features. By subscribing to Pro, you agree to the following:

• Pricing: The Pro subscription is billed at $4.00 per month. Prices are subject to change with 30 days' prior notice to existing subscribers.
• Billing Cycle: Your subscription will automatically renew on a monthly basis unless you cancel before the end of the current billing period.
• Payment Processing: All payments are processed by Stripe, Inc. By subscribing, you also agree to Stripe's terms of service.
• Cancellation: You may cancel your Pro subscription at any time through your account settings. Upon cancellation, you will retain access to Pro features until the end of your current billing period.
• Refunds: Subscription fees are generally non-refundable. We may, at our sole discretion, issue refunds on a case-by-case basis for extenuating circumstances.
• Feature Changes: We reserve the right to modify, add, or remove Pro features at any time. If we materially reduce the features included in a Pro subscription, we will provide notice and you may cancel without further charges.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law or regulation.
• Scrape, crawl, or use automated means to access the Service at a rate that degrades service for other users, without our prior written consent.
• Attempt to gain unauthorized access to any portion of the Service, other users' accounts, or any systems or networks connected to the Service.
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.
• Use the Service to stalk, harass, or harm another individual, including using incident data to identify or locate specific persons involved in emergency incidents.
• Reproduce, duplicate, or resell the Service or any portion thereof without express written permission.
• Misrepresent your identity or affiliation with any person or entity, or impersonate any person or entity, including MCFRLive personnel.

8. Intellectual Property

The Service and its original content (excluding public dispatch data), features, and functionality are and will remain the exclusive property of MCFRLive. The Service is protected by copyright, trademark, and other applicable intellectual property laws. Our name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks or trade dress. You may not use such marks without our prior written permission.

The underlying public dispatch data is derived from public records and is not subject to our copyright. However, the specific presentation, arrangement, compilation, user interface, and added value features of the Service are proprietary to MCFRLive.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We do not warrant that (a) the Service will function uninterrupted, be secure, or be available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; (d) the results of using the Service will meet your requirements; or (e) the dispatch data displayed is accurate, complete, current, or reliable.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall MCFRLive, its operators, contributors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of, or inability to access or use, the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service, including but not limited to dispatch data, incident details, location information, or unit status.
• Unauthorized access, use, or alteration of your transmissions or content.
• Any decisions or actions taken or not taken based on information displayed on the Service.
• Any delay, inaccuracy, error, or omission in the dispatch data or any other information provided through the Service.
• Any interruption, suspension, or termination of the Service, whether or not such interruption was planned or foreseeable.

In no event shall our total aggregate liability to you for all claims arising from or related to the Service exceed the amount you have paid us in subscription fees during the twelve (12) months preceding the claim, or fifty dollars ($50.00), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless MCFRLive, its operators, contributors, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property, privacy, or proprietary right; or (d) any claim that your use of the Service caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Service.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately. If you have an active Pro subscription, we will process a pro-rated refund for the remaining days in your billing period at the time of termination, unless the termination was due to your violation of these Terms.

All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Martin County, Florida, and the parties hereby consent to the personal jurisdiction and venue therein.

Any dispute arising from or relating to the subject matter of these Terms that cannot be resolved through good-faith negotiation between the parties within thirty (30) days shall be finally settled by binding arbitration in Martin County, Florida, in accordance with the rules of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in court to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, and any other legal notices or agreements published by us on the Service, constitute the entire agreement between you and MCFRLive regarding the use of the Service, superseding any prior agreements between you and MCFRLive relating to the Service.
